DISTANCE SALES AGREEMENT

1. PARTIES

The Parties below have accepted, declared, and undertaken the terms and conditions specified in this agreement. The Parties will hereinafter be referred to collectively as "the Parties", and individually as "the Party".

The BUYER agrees that by confirming the order, they will be obliged to pay the order amount, shipping fee, and other taxes.

2. DEFINITIONS

  • LAW: Law on Consumer Protection No. 6502.
  • REGULATION: Distance Contracts Regulation.
  • SERVICE: Any consumer transaction other than the provision of goods.
  • SELLER: PINAR BİRİM ART
  • BUYER: A real or legal person who shops through the SELLER's website.
  • SITE: The website belonging to PINAR BİRİM ART.
  • GOODS/PRODUCT: Movable items, software, audio, and video recordings sold.

3. SUBJECT OF THE AGREEMENT

This agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product ordered by the BUYER from the SELLER's website.

The listed prices are sales prices and are valid until changed.

6. PRODUCT INFORMATION SUBJECT TO THE AGREEMENT

6.1. The main features of the product are specified on the website.

6.2. The sales price is stated including taxes.

6.3. For orders over 3500 TL, the shipping fee will be covered by the SELLER.

7. INVOICE INFORMATION

8. GENERAL PROVISIONS

8.1. The BUYER acknowledges having read and understood all information about the product ordered on the SITE and giving electronic approval.

8.2. The ordered product will be delivered within a maximum of 30 days.

8.3. The SELLER may send a different product of equal quality and price by informing the BUYER.

8.4. If the SELLER determines that the product cannot be delivered, the amount will be refunded to the BUYER within 14 days.

8.5. If the BUYER made payment by credit card, the SELLER's delivery obligation will cease if the payment fails.

8.6. After receiving the product, the BUYER must create a return/exchange request within 14 days.

9. RIGHT OF WITHDRAWAL

9.1. The BUYER has the right to return the product within 14 days of receiving it.

9.2. For the right of withdrawal, the product must be in its original packaging, complete, and undamaged.

9.3. The BUYER must submit the return request via the SELLER's email address.

9.4. Products for which the right of withdrawal cannot be exercised:

  • Personal care, underwear, disposable, and hygiene products.
  • Cosmetic and hygiene products with opened packaging.

9.5. If the BUYER exercises the right of withdrawal, the product price will be refunded within 14 days.

10. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER pays by credit card and delays their debt, they are obliged to pay the interest determined by the bank.

11. COMMUNICATION AND SUPPORT

The BUYER can receive support by using the SELLER's communication channels for any questions regarding the product.

12. AUTHORIZED COURT

In all disputes, the Consumer Arbitration Board and Consumer Courts where the BUYER's domicile is located are authorized.

For the year 2024, disputes under 104,000 TL can be submitted to Consumer Arbitration Boards, and amounts above this to Consumer Courts.

13. EFFECTIVENESS

The BUYER declares that they accept this agreement when placing an order.
